Atempo Policy on Trademark Usage
Atempo, Inc. has a reputation for providing high quality products and services. To preserve its reputation and protect its trademarks in its products and services, Atempo diligently guards against any violation of its trademarks.
Atempo acknowledges the desire of third parties to show affiliation with Atempo. Without written permission from Atempo, however, you should not use Atempo trademarks in a manner that suggests affiliation with or endorsement by Atempo. Only parties with written permission from Atempo are allowed to use specified Atempo trademarks in accordance with the applicable terms. This policy is subject to change at any time and without notice.
Trademarks
Trademarks are used in identifying and distinguishing a product, service, program, or company. Trademarks can take the form of letters and words, logos, pictures, a combination of words and a logo, slogans, colors, product shapes, and sound. A trademark owner has the exclusive right to use its trademarks in connection with its products or services and is obligated to prevent others from using its trademarks inappropriately.
It is Atempo policy to enforce its trademark rights against any third-party infringer. Atempo maintains a portfolio of trademarks.

Appropriate Symbols
The appropriate symbol (e.g., ™ for unregistered trademarks and ® for registered trademarks) must appear in each use of an Atempo trademark, typically in superscript font on the upper-right shoulder of the trademark. For example:

The appropriate symbol must be used with the first or most prominent appearance of a trademark in a publication, but need not be used with each subsequent appearance, if it has been used in a way that the reader is clearly placed on notice.
Use as Adjectives, not Nouns or Verbs.
Atempo trademarks are adjectives, and should generally be used together with the generic terms they modify. The words "software" or "product" or "program" or similar generic language (i.e. "data storage program"), should immediately follow an Atempo trademark. Consequently, Atempo trademarks should not be used as nouns or verbs, nor should they be used in a plural or possessive form. For example:
CORRECT: Try the Live Backup™ program risk-free.
INCORRECT: Try Live Backup™ risk-free.
CORRECT: Time Navigator™ software makes it easy to manage enterprise data.
INCORRECT: Time Navigator™ makes it easy to manage enterprise data.
Additional Restrictions
To ensure that you are using the Atempo trademarks properly and appropriately, always avoid any of the following:
- Do not use an Atempo trademark in a manner that is likely to show or imply either an affiliation with Atempo or an endorsement by Atempo of specific companies, products, services, materials, courses, or programs without the permission of Atempo.
- Do not use the Atempo corporate logo or any other Atempo logo in any materials that you create independently without the permission of Atempo.
- Do not use an Atempo trademark in a manner that is likely to confuse the public about the origin of products, services, materials, courses, or programs.
- Do not use a mark similar enough to an Atempo mark that it could be confused as an Atempo trademark (considering visual, phonetic, and connotations of the marks).
- Do not alter, adapt, modify, animate, or morph any Atempo trademarks. Examples of what not to do include shortening a trademark to an initial (Atempo to C) in an acronym, hyphenating a trademark with another prefix or word (Atempo -led), or using a slash mark with any trademark (Atempo /XYZCo).
- Do not use the Atempo name or Atempo trademarks as the visual focal point of any materials.
- Do not use an Atempo trademark in a manner that is likely to dilute, defame, disparage, or harm the reputation of Atempo. Do not use the Atempo name as a part of a product, service, solution, or program name.
Permissible Reference to Atempo Materials
Atempo acknowledges that the use of Atempo trademarks, excluding any Atempo logos, may be necessary to describe the subject matter of some materials, products, and/or programs. Consequently, Atempo does allow descriptive uses of its trademarks. The following guidelines outline permissible use of Atempo trademarks:
The Atempo name and other Atempo trademarks, excluding any Atempo logos, may be used ONLY when necessary to describe the subject matter of the materials, products, and/or programs. All uses must be accurate and descriptive in nature so there is no likelihood of confusion to the public. Examples:
- Do Say: XYZ Company is a member of the Atempo Reseller Program
- Do Say: XYZ Company delivers authorized Atempo training
- Do Say: Atempo is a customer of XYZ Company
- Do Say: XYZ Company’s ABC product has been successfully tested to be compatible with Atempo wireless networking equipment
- Do Not Say: XYZ-Atempo training
- Do Not Say: XYZ-Atempo Software
- Do Not Say: XYZ Company, Atempo -preferred training institution
- Do Not Say: XYZ Company’s product is Atempo -compatible

Disclaimer and Acknowledgement
If permission is granted, all uses of Atempo trademarks should be coupled with the following disclaimer, as well as an acknowledgement of Atempo trademarks. The disclaimer and acknowledgement should appear with your company’s standard notices and disclaimer, and must appear conspicuously on your company’s materials.
